Las crisis matrimoniales no necesariamente son desencadenadas por crisis económicas pero es indudable que la cuestión económica es uno de los aspectos fundamentales que se ha de tratar en toda ruptura de pareja y muy especialmente cuando hay hijos de por medio.
Si bien se tiende a pensar que “alimentos” es sólo lo que comemos debe saber el amable lector que, desde el punto de vista jurídico, nuestro Código Civil engloba en ellos todo lo indispensable para el sustento, habitación, vestido y asistencia médica, por lo que el contenido es mucho mayor de lo que el propio término podría dar a entender en un principio.
Partiendo de lo anterior es indudable que cuando el matrimonio quiebra y cada una de los miembros de la pareja decide hacer la vida por separado, hay que decidir y resolver el tema de la manutención de los hijos, sí o sí.
Y para resolver este asunto, como todo en esta vida, hay dos maneras de hacerlo: o por las buenas o por las malas o, como diría un abogado matrimonialista, de mutuo acuerdo o de forma contenciosa.
Sobre la primera forma –la amistosa- no me voy a extender en explicar en qué consiste el modo más recomendable, rápido y barato ( entre otras razones porque aquí no habría que celebrar un juicio) de dar solución a las rupturas de parejas y todo lo que ello supone cuando hay hijos afectados. El que los miembros de la pareja negocien –siempre bajo la necesaria orientación y asesoramiento legal- se pongan de acuerdo y firmen un convenio regulador supone dejar en sus propias manos la regulación sobre la custodia, el uso de la casa, las visitas, las vacaciones, los gastos de los niños…etc que nadie conoce mejor que ellos. Y todo eso en el bien entendido de que luego serán el juez y el fiscal (quienes legalmente deben velar por el interés de los menores ) los que decidan si tal convenio es razonable o se han omitido o recogido deficientemente esos aspectos. En este último caso se tendrá que reelaborar y firmar otro convenio que pase el filtro de idoneidad y se dicte sentencia aprobándolo.
El tema se vuelve más delicado cuando los progenitores ni se plantean negociar o cuando las negociaciones no han fructificado.
¿ Qué cantidad de dinero corresponde pagar por un hijo? Si esta es la pregunta que usted se realiza cuando pretende divorciarse sin acuerdo déjeme que le diga varias cosas. La primera es que depende. Para empezar, depende de si los hijos son menores o mayores de edad cuando llega la ruptura, pues el tratamiento es bastante diferente en cada caso. En este punto no quiero dejar pasar la oportunidad de dejar zanjado un tema que trataremos en la próxima entrega cuando hablemos de los alimentos de hijos mayores de edad y es: no se dejan de pagar alimentos ya establecidos para los hijos porque éstos cumplan 18 años.
Centrada la explicación en los hijos más pequeños, también dependerá de las necesidades de estos niños en cada momento. Esto, que parece una obviedad, significa algo tan concluyente como que el primer patrón o guía a seguir es siempre el interés del menor, hasta el punto de que nuestros tribunales lo priorizan sobre los intereses de los demás, incluso sobre las necesidades del obligado a pagarlos, por muy importantes que le parezcan.
No son pocas las veces en que padres o madres me comentan en el despacho que, porque le pasó a un amigo/a o porque lo ha oído en algún sitio, corresponde pagar por cada hijo 150’00 €. Falso. Cada familia es un mundo, cada hijo es diferente y sus necesidades también, como lo son los ingresos y gastos de todos y cada uno de los que se divorcian en este país, por lo que pretender ir a un juez con cifras cerradas es desconocer la materia que tratamos. Tanto es ello así que los intentos del propio Consejo General del Poder Judicial por marcar a los jueces unas tablas orientadoras para alimentos han tenido una aplicación casi nula.
Bien es verdad que existen unos estándares más o menos lógicos y razonables y que debe mediar una cierta proporcionalidad entre la cuantía de los alimentos y los recursos económicos de los progenitores y sus obligaciones económicas, bien las ya contraídas durante el matrimonio ( préstamos, hipotecas.. ) o las que ha debido asumir al abandonar el domicilio conyugal ( alquiler de una nueva casa ) pero déjenme, ya para terminar, que les diga que, aún en los casos en que el pagador está en situación de desempleo, la Audiencia Provincial de Santa Cruz de Tenerife viene determinando en sus últimas sentencias que el “mínimo vital” para cubrir decentemente el desarrollo físico, intelectual y emocional de un hijo es de 180’00 € al mes.
